You are hereby notified that after careful consideration of your application
dated December 8, 1998 and after a Public Hearing as required by Chapter 40A, M.G.L., the Appeal Board voted:

REPRESENTATIONS TO BOARD:
1. The applicant requested a special permit to allow the removal of an existing mobile home and the construction of a single family home on a pre-existing, non-conforming lot at 521 Spring Street with the existing garage to remain.
2. The existing mobile home as been on the site since 1951. The lot has 100 feet of frontage and is comprised of 14,000 square feet. The new house will be a 24 foot by 44 foot raised ranch. The property is located in a Residence AA District.
3. The petitioner’s representative, Al Vautrinot of Vautrinot Land Surveying, said that the mobile home is approximately 26 feet from the front corner of the lot and about 10 feet from the side line. The new house will be 63 feet from the street, 25 feet from each side lot line and 30 feet from the rear lot line.
4. No abutters who attended the hearing voiced any objections to the proposal.
5. Building Inspector/Zoning Enforcement Officer Samuel Germaine said that there should be 20 feet between the house and the garage. The plans submitted show only eight feet.
6. The Planning Board found the proposed use to be more compatible with the area but urged conformity with setbacks.
6. The Board determined that the proposed use would not be significantly more intrusive on the neighborhood but decided to give the applicant leeway in the location of the house to provide as much distance between the house and garage as possible.
. With regard to the Special Permit the Board took into consideration each of the following:

a) Social, economic, or community needs which are served by the proposal;
b) Traffic flow and safety;
c) Adequacy of utilities and other public services;
d) Neighborhood character and social structures;
e) Impacts of the natural environment;
f) Potential fiscal impact.
DECISION:
The Application for a Special Permit is granted, subject to the following conditions:
1. Applicant shall obtain all necessary permits from all other Boards in the Town of Hanson;
2. The project shall be constructed in conformity with the plan filed with this board with the petition except that the applicant may place the house within an area up to 10 feet from the property line depending upon the topography of the lot to see if the space between the house and garage can be
increased; and
3. This decision must be recorded with the Plymouth Registry of Deeds within one year from the filing of this decision with the Clerk of the Town of Hanson.
ANY PERSON AGGRIEVED BY THIS DECISION MAY APPEAL TO THE SUPERIOR COURT DEPARMENT FOR PLYMOUTH COUNTY, BY BRINGING ACTION WITHIN TWENTY (20) DAYS AFTER DECISION HAS BEEN FILED IN THE OFFICE OF THE TOWN CLERK.
